New Bill To Allow Birth Certificate Gender Change Without Divorce Requirement In NSW

Independent Sydney MP Alex Greenwich and NSW Greens spokeswoman Mehreen Faruqi are expected to introduce a private member’s bill to the New South Wales Parliament on Tuesday so that transgender people can have their gender changed on their birth certificates without them having to divorce their spouses.

The Births, Deaths and Marriages Registration Act 1995 currently does not permit a married person to alter the record of their sex or to register a change of sex. This forces a married person who has undergone sex affirmation to choose between divorcing his or her spouse and having an inaccurate birth certificate.

Dr Faruqi and Greenwich will call on their counterparts across the country to introduce similar bills as other Australian states and territories have similar laws.
